PRIVACY POLICY

Privacy policy

In short: the UP↑SCALE app keeps your weights, records and lists on your own devices - we never get them. We get personal data only when you order a licence, write to us, or allow statistics on this website.

Who is responsible

FARM 23 SL, Calle La Morada, Num. 2, Puerta 2, 38650 Los Cristianos, Santa Cruz de Tenerife, Spain, NIF B76609064, e-mail our e-mail address (picture) (the controller under the GDPR). We have no data protection officer; please write to the address above.

Visiting the website

When you open a page, your browser sends technical data to our server: IP address, date and time, the address of the page, the page you came from, browser and operating system. The server keeps them in log files to deliver the pages and to protect against attacks, for at most 14 days, then they are deleted (legal basis: art. 6 (1) f GDPR, our interest in a safe website). The server stands in a data centre of Leaseweb Deutschland GmbH (data centre in Germany), who works for us as a processor.

The website sets no cookies of its own. It stores your choice for the statistics (below) in your browser (localStorage), nothing else.

Statistics (Google Analytics) - only if you allow it

Only if you click Accept in the statistics box, we use Google Analytics 4 of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, to count visits, the pages seen, downloads, firmware installs and orders (the amount, never your name, e-mail or Device ID). Google sets cookies (_ga, _ga_*, up to 2 years) and processes your IP address (which, Google says, Google Analytics 4 does not store), device and browser data. Data can go to Google LLC in the USA; Google takes part in the EU-U.S. Data Privacy Framework. No adverts, no advertising features, no data for adverts.

Legal basis: your consent (art. 6 (1) a GDPR, art. 22.2 LSSI). Without your consent nothing of Google is loaded. You can change your choice at any time: . More: Google's privacy policy.

Ordering a licence

For an order we need: your name, e-mail, country, the Device ID of each board, the product, and as a business customer also company, address and VAT ID; optional: your message. We use them to make the contract, to send you the payment details, the licence keys and the invoice, for questions about your order, and to keep the books (legal basis: art. 6 (1) b and c GDPR). We send you the confirmation and the keys by e-mail. If you do not give us these data, we cannot take your order.

We keep order and invoice data as long as the commercial and tax laws demand (in Spain usually 6 years, art. 30 Código de Comercio), and the link between a Device ID and its licence as long as the licence can be used, so that we can send you a lost key again.

If you pay by bank transfer, your bank and our bank process the payment. If you order through one of our partners, or your board was sold by a partner, this partner sees the order number, the Device ID, the product and the price of the order (not your name and not your e-mail) to get his commission.

Licence services of the app

  • Find a lost key (the app's button, or the page "lost licence"): the app sends the Device ID of your board to our server, which answers with the key of this board. We store nothing new; the server counts the requests per IP address for one hour against misuse.
  • Seal certificate (ENTERPRISE, only after you confirm in the app): the app sends the Device ID and the public key of your scale; the certificate goes to the e-mail address of your order.
  • Contact: if you write to us, we use your e-mail and your message to answer, and keep them as long as the matter needs it (art. 6 (1) b or f GDPR).

The UP↑SCALE app

The app runs in your browser and talks to your scale over Bluetooth. Your weights, recipes, THINGs, records, users, members and settings stay on your devices (in the browser and on the scale); we do not get them. The app has no tracking, no adverts and sets no cookies. If you store personal data of other people in the app (for example members, customers or users), you are responsible for them under the GDPR - we do not process them.

Only these functions go to the internet, and only when you use them:

  • Barcode food lookup: the barcode goes to Open Food Facts (Open Food Facts, France, privacy).
  • Cocktail mode: the search words go to TheCocktailDB (thecocktaildb.com).
  • Recipe import from a web address: the app loads the page you entered from that website.
  • LIMS forwarding (ENTERPRISE, off by default): the data go to the server you entered - your own system.
  • Licence lookup and seal certificate: see above.
  • Loading the app and updates: the files come from our server (see "Visiting the website").

The firmware update page installs the firmware over a USB cable from your browser; the connection to your device stays on your computer.

Your rights

You have the right to access your data, to have them corrected or deleted, to restrict their processing, to receive them in a common format (portability), and to object to a processing based on our interest (art. 15 - 21 GDPR). A consent can be withdrawn at any time for the future. Write to our e-mail address (picture).

You can also complain to a data protection authority, in Spain the Agencia Española de Protección de Datos (AEPD), C/ Jorge Juan 6, 28001 Madrid, www.aepd.es.

We do not sell your data, we do not use it for adverts, and we make no automated decisions about you.
